Terms and Conditions of Use

Please read carefully. These Terms and Conditions govern your use of the lemeridien.com web site (the "Site") and your relationship with Le Meridien Hotels & Resorts Limited group ("Le Meridien, we or us"), together with any specific terms set out on individual pages within the Site. These Terms and Conditions affect your rights and liabilities under the law. If you do not agree to them, please do not use the Site. These Terms and Conditions were last updated on 3 September 2004.

Use of the Site

The Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Site you agree to be bound by these Terms and Conditions.

You may only use the Site if you are at least 18 years of age and can enter into binding contracts (our site is not available for use by minors). You will be financially accountable for all uses of the Site by you. You may only use the Site to make legitimate reservations or purchases. You may not use the Site to make any false, fraudulent or speculative reservation or any reservation in anticipation of demand; to post or transmit any unlawful, threatening, libellous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law; or for any other purpose that is unlawful or prohibited by these Terms and Conditions. We may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of the Site.

Availability of the Site

The Site is available worldwide to anyone with Internet access. However, the Site may not be continuously available due to maintenance or repairs or due to computer problems or crashes, disruption in Internet service or other unforeseen circumstances. The Site contains information on our worldwide products and services, not all of which are available in every location. A reference to a product or service on the Site does not imply that such product or service is or will be available in your location. The content of the Site, including advertising content, is intended for use and display only where its use and display are permissible in accordance with applicable laws and regulations.

Content Featured on the Site

All material on the Site and news sent by email (the "Content") is protected by copyright, trade mark, database and other intellectual property rights, and belongs to Le Meridien. You may retrieve and display Content from the Site on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your personal, non-commercial use. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the Content without written permission from Le Meridien.

No licence is granted to you in these Terms and Conditions to use any trade mark of Le Meridien including, without limitation, "Le Meridien", "Le Meridien Moments" and "Le Meridien GuestBook".

Online Reservation/Occupancy

If you use the Le Meridien Online Reservation facility set out in the Site, terms and conditions regarding availability, prices and cancellation apply to each room rate quoted and you should read carefully the room rate details that are provided before proceeding to complete your reservation. Any special needs must be notified at the time of reservation but will not be guaranteed.

All reservations are subject to availability. If you cancel your reservation after the cancellation deadline indicated your credit/charge card will be debited for the value of the first night stay booked in that room.

In relation to bookings (a) made by one or more individuals or by an agency (b) on behalf of one or more proposed guests in the same party and (c) if involving more than 4 rooms at the same property for the same period of stay, Le Meridien reserves the right to honour such bookings only in respect of the first four rooms booked.

Limitation of Liability and Disclaimer

Whilst Le Meridien endeavours to ensure that the Content is accurate, the information is of a general nature and not intended to comprise all of the information relating to the products or services referred to on the Site. Therefore, Le Meridien cannot guarantee that the Content will be suitable to your circumstances or adequate to meet your particular requirements.

Le Meridien cannot accept any responsibility for errors or omissions beyond its reasonable control that may affect any of the Content.

Le Meridien cannot guarantee that access to the Site will be uninterrupted or entirely error free. Le Meridien will not be responsible in any circumstances for any consequential or incidental damages (including but not limited to loss of profits, loss of privacy and loss of data) or for any other indirect, special or punitive damages whatsoever that arise out of or are related to the use of the Site.

The Site may contain links to other web sites which are outside our control and are not covered by these Terms and Conditions. If you access other sites using the links provided, the operators of those sites will be responsible for their availability and content.

Notwithstanding the provisions of this section, Le Meridien's liability will not be limited in the case of death or personal injury directly caused by Le Meridien's negligence.

Registration

If you register or provide us with your details via the Site, you must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering.

The information that you provide about yourself to Le Meridien will only be used by Le Meridien in accordance with its Privacy Policy.

Changes to these Terms

Le Meridien reserves the right, at its discretion, to make changes to any part of the Site. Due to its policy of updating and improving the site, Le Meridien may wish to change these Terms (including those relating to your use of the Content). When terms are changed, Le Meridien will notify you by indicating at the start of these Terms when they were last modified. It is, therefore, important that each time you use the site you check to see whether there is a notification of a change to the Terms. If you use the Site after Le Meridien has published or notified you of the changes, you are agreeing now to be bound by those changes. If you do not agree to be bound by those changes, you should not use the Site any further.

Advertising and Sponsorship

Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant law. Le Meridien will not be responsible for any error or inaccuracy in advertising or sponsorship material.

Promotions and Offers

Le Meridien may make available on the Site information regarding specific services, offers or promotions that Le Meridien is conducting. Any such service, offer or promotion is subject to the specific terms, conditions and restrictions listed on the Site in connection with such service, offer or promotion. Each service, offer and promotion is void where prohibited by law. Please refer to and read carefully the terms, conditions and restrictions included on the Site in connection with each service, offer or promotion.

Competitions and Prize Draws

From time to time Le Meridien may run competitions, free prize draws and promotions on the Site. These are subject to additional terms that will be made available at the time of such competitions.

Choice of Law and Jurisdiction

These Terms shall be governed by, and construed in accordance with, English law. We both agree, for the exclusive benefit of Le Meridien, that the Courts of England shall have the exclusive jurisdiction to determine any disputes which may arise out of, under, or in connection with this agreement; save that, it being agreed that this clause conferring jurisdiction for the benefit of Le Meridien only, Le Meridien shall retain the rights to bring proceedings against you in the Courts of any other country which has jurisdiction.

General

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy.
